Common Unethical Tactics Used by Unethical Real Estate Agents in Ontario

In Ontario, like many other Real Estate Markets, unethical practices by unscrupulous agents and brokers can sometimes occur. While most real estate professionals adhere to a code of ethics, a few may resort to deceptive tactics to gain clients or close deals. Understanding these malpractices helps clients navigate the market safely.

1. Phantom Bidding: One of the most common unethical tactics in the Ontario real estate market is the use of phantom bids. This happens when agents falsely claim there are competing offers on a property to pressure a potential buyer into raising their bid. This practice inflates prices and coerces buyers into making decisions without full information.

2. Dual Agency Conflicts: Dual agency occurs when one agent represents both the buyer and the seller in a transaction. While this is legal in Ontario, it often creates conflicts of interest. An unethical agent might prioritize the seller’s interests to close the deal quickly or push the buyer to accept less favorable terms. This lack of impartiality can hurt both parties, with the agent standing to gain the most.

3. Underpricing to Drive Bidding Wars: Some agents deliberately underprice homes to spark bidding wars. While it can generate excitement and high offers, it often misleads buyers into thinking a property is more affordable than it is. This tactic can cause buyers to spend more than their budgeted amount and inflate home values in the market artificially.

4. Misrepresentation of Property Information: Unethical agents may provide incomplete or misleading information about a property, such as downplaying defects, overstating the value, or exaggerating the potential for future appreciation. This is particularly harmful to buyers, as they may end up purchasing a property based on false assumptions.

5. Unlawful Steering: Real estate agents are not allowed to direct clients toward or away from certain neighborhoods based on personal biases. However, steering can occur when agents use subtle suggestions or misinformation to influence a buyer’s decision, which can contribute to housing discrimination.

It is important for buyers and sellers to be aware of these tactics, ask the right questions, and work with trustworthy, licensed professionals to ensure a fair and transparent real estate transaction.
